Transformative Conciliation
Transformative Conciliation, also known as Relationship Urgent Care, is a method and communication process to reduce tensions, improve communications, and educate parties about their needs and interests with the general purpose of getting the parties to want to resolve their disputes, agree on a process to do it, and joint problem solving efforts to identify the best ways of meeting all or most of the interests of the parties.
Characteristics of this approach:
- Less formal
- Led by the parties, assisted by the neutral mediator
- Focused on problem exploration, idea generation, and concept evaluation to propose and generate ideas to solve a stated problem
- Generally does not include lawyers
Facilitative Mediation
A neutral mediator provides procedural assistance to enhance information exchange, help disputing parties resolve their differences, promote effective problem solving and decision-making, and negotiate a mutually agreeable settlement.
Characteristics of this approach:
- More formal
- Led by the neutral mediator; outcome driven by parties.
- Focused on settlement
- May include lawyers
